In Arbitration & Mediation understanding each party’s position is a given. My arbitration/mediation program for construction disputes is considered unique.

Construction Disputes

   Review contracts, other documentation covering the scope of the work; conduct site inspections; evaluate workmanship & conformance with contractual obligations; determine professional liability exposure; estimate repair, reconstruction & completion costs; establish fair & reasonable value; determine State & Federal Code compliance or violations; determine conformance with industry standards; issue detailed, factual & objective reports for trial, arbitration, mediation or settlement.

   In the course of investigation licenses and registrations of all parties is done, including the credentials of other Expert Witnesses.

Personal Injury Claims


   Conduct site inspections; interview injured parties (preferably on site), others if relevant; evaluate the site conditions; determine negligence if any; cite State & Federal Code compliance/violations; issue detailed, objective reports for trial, arbitration, mediation or settlement.

Home & Building Inspections

   Review inspection reports for clarity & accuracy; conduct site inspections; evaluate Inspectors’ competence; check Inspectors’ licensing & insurance coverage; check membership in recognized organizations; identify errors & omissions; cite breaches of Industry Standards of Practice; estimate repair, replacement or reconstruction costs; issue detailed, objective reports for trial, arbitration, mediation or settlement.

In March 1999 I was invited to testify at a subcommittee hearing of Massachusetts State Senators & Representatives in support of a bill to examine, license & insure home inspectors. A section of the bill was recommended by me. The bill is now law.

Test equipment for conformance with manufacturer’s specifications, recognized usage. Interview injured parties.

Research professional liability claims in construction and personal injuries.

Condominiums

Inspect structural and mechanical building components, determine condition, life expectancy; forecast replacement costs.
